The proposed rules are part of Senate Bill 458 and are expected to take effect for policies issued or renewed on or after September 1, 2026.<\/p><br\/><a href=\"https:\/\/mms.businesswire.com\/media\/20260512931467\/en\/2803891\/5\/ChadWilsonLawFirm-BlueLogo.jpg\"><img src=\"https:\/\/mms.businesswire.com\/media\/20260512931467\/en\/2803891\/22\/ChadWilsonLawFirm-BlueLogo.jpg\" \/><\/a><br\/><a href=\"https:\/\/mms.businesswire.com\/media\/20260512931467\/en\/2803891\/5\/ChadWilsonLawFirm-BlueLogo.jpg\"><img src=\"https:\/\/mms.businesswire.com\/media\/20260512931467\/en\/2803891\/21\/ChadWilsonLawFirm-BlueLogo.jpg\" \/><\/a><p>\n<b>Major Proposed Changes<\/b><\/p><p>\nThe proposed rules would:<\/p><ul class=\"bwlistdisc\">\n<li>\nRequire residential insurance policies to include appraisal rights for disputed claims.<\/li>\n<li>\nAllow either the insurance company or policyholder to demand appraisal without needing both parties to agree.<\/li>\n<li>\nRequire insurance companies to provide written notice explaining appraisal rights when a claim is accepted or denied.<\/li>\n<li>\nCreate statewide deadlines for selecting appraisers, umpires, and completing the appraisal process.<\/li>\n<li>\nRequire appraisers and umpires to be qualified, independent, and disinterested in the outcome of the dispute.<\/li>\n<li>\nMake appraisal awards binding unless there is fraud, material mistake, or lack of authority.<\/li>\n<\/ul><p>\n<b>Residential Property Claim Timeframes<\/b><\/p><p>\nFor homeowners and residential property claims:<\/p><ul class=\"bwlistdisc\">\n<li>\nPolicyholders generally have <b>1 year<\/b> after a claim decision to demand appraisal.<\/li>\n<li>\nEach side has <b>20 days<\/b> to select an appraiser after appraisal is demanded.<\/li>\n<li>\nAppraisers have <b>15 days<\/b> to select an umpire.<\/li>\n<li>\nAppraisers must attempt to resolve the dispute within <b>120 days<\/b>.<\/li>\n<li>\nIf an umpire is needed, the appraisal award must generally be completed within <b>240 days<\/b>.<\/li>\n<\/ul><p>\n<b>Public Hearing and Public Comment Deadlines<\/b><\/p><p>\nThe Texas Department of Insurance will hold a public hearing on the proposed rules on:<\/p><ul class=\"bwlistdisc\">\n<li>\n<b>June 2, 2026<\/b><\/li>\n<li>\n<b>10:00 a.m. Central Time<\/b><\/li>\n<li>\nBarbara Jordan State Office Building\n<br\/>1601 Congress Avenue\n<br\/>Austin, Texas 78701\n<br\/>Room 2.035<\/li>\n<\/ul><p>\nTDI stated that the hearing will be available both in person and online.
